Background
A La Cima Spanish (the “Tutor”) provides online Spanish tutoring and teaching services.
Read these terms and conditions carefully.
These terms and conditions may be updated from time to time. Review the terms and conditions regularly to ensure you are aware of changes.
The most recent update was June 1, 2026.
If you do not agree to the terms and conditions, do not use this service.
Using services provided by the Tutor indicates the Client agrees to these terms and conditions set forth in this document.
The Tutor agrees to provide services for the Client according to these terms and conditions.
Services Provided
Within these terms and conditions, adults paying for their own sessions or parents/legal guardians purchasing sessions for their minor children will be referred to as the “Client.” The Tutor offers the following services to those purchasing tutoring and teaching services:
informal assessment of the student’s current needs for growing greater fluency in Spanish
establishing an individualized plan of action for tutoring and teaching sessions for the student
establishing agreed upon dates and times for tutoring and teaching sessions
sending a Google Meet link to the Client’s email prior to the beginning of the session
sending to the Client a follow-up summary and suggestions email after the conclusion of the tutoring and teaching session
providing general duty of care wherever reasonable and necessary in relation to their Student during tutoring and teaching session
Client agreements
Client is of the opinion that the Tutor has the qualifications and expertise needed to provide them with tutoring and teaching service and/or to their minor child (“their Student”) as set out in these terms and conditions.
Client has the legal right to hire and agrees to hire the Tutor to provide Spanish tutoring and teaching services to themselves or their Student.
Client agrees to provide, at their expense, the needed materials for each session which may include:
Internet access that functions with video learning
Composition book or other method to keep session materials organized and accessible in future sessions
Pencils, pens, markers
Computer with accessible camera
Headset with microphone or other method to avoid background noise
Printed copies of materials sent to the Client prior to the session
Other materials as agreed upon between the Client and the Tutor
Client agrees to ensure they or their Student maintains the Spanish tutoring and teaching composition book (or alternative) organized and in good condition as directed by the Tutor.
Client agrees to ensure that they or their Student is on time for scheduled sessions.
Client agrees to allow only the designated Student access to the Tutoring and teaching session.
Client agrees to be physically accessible to their minor Student during sessions for technical issues or other needs that arise.
Client agrees to not record the sessions whether directly from the device they or their Student is using or via any other means.
Client agrees to pay for services prior to booking services.
Tardy and missed class policy
17. Without at least 24 hours prior notice, if the Student is late or does not attend, the Client agrees to pay the full amount for the session. When a Student is more than 20 minutes late, the session will be cancelled and the Client will be required to pay the full amount of the session. Missed or late classes will not be prorated, refunded or rescheduled.
Cancellation and rescheduling
Should the Client need to cancel or reschedule, they may do so at no cost up to 24 hours in advance. Less than 24 hours notice, the Client will be required to pay the full amount.
Should the Tutor need to cancel or reschedule, it agrees to provide notice to the Client at the earliest opportunity. Additionally, rebooking will be offered at no cost. If the missed session cannot be rebooked in a reasonable amount of time, the Tutor will refund the full amount of the missed session cost.
Intellectual Property
All materials created prior to, during, and after sessions by the Tutor are considered to be the intellectual property of the Tutor. These materials are copyrighted with all rights reserved. The Client is granted a limited-use license of this intellectual property when the Tutor makes it accessible, whether through sending a digital copy to the Client, or by sharing via an online session. Such use is limited to the Tutoring and teaching services provided by the Tutor.
Limitation of Liability
It is understood that the Tutor will have no liability to the Client or their Student or any other party for any loss or damage whether direct, indirect, or consequential, which may arise from the provision of Tutoring and teaching services through the Tutor.
Confidentiality
Client information, and that of their Student, that is personally identifiable, will be treated confidentially by the Tutor and will not be shared with any third parties except as required by law.
Terms
All copyright and intellectual property claims by the Tutor remain in full effect after the termination of services with A La Cima Spanish. The remaining terms and conditions are in effect until the end of the scheduled session or sessions. The terms and conditions are governed by and construed in accordance with the State of Florida.
